Elder Abuse
The Elder Abuse and Dependent Adult Civil Protection Act (EADACPA) was intended by the legislature "to enable interested persons to engage attorneys to take up the cause of abused elderly persons and dependent adults.”. It provides for enhanced or additional remedies for existing causes of action that involve physical abuse or neglect, abduction, or financial abuse of elders. The remedies include, under certain conditions, postmortem recovery for pain and suffering and mandatory attorney fees and costs, including fees for the services of a conservator litigating an elder abuse claim.
Since its enactment in 1991, EADACPA has become the cornerstone of most actions on behalf of elders. Because of the enhanced remedies available under EADACPA, as well as under other remedial statutes applicable in elder abuse situations, the plaintiff's bar has become increasingly interested in pursuing elder abuse actions against nursing home operators and others for physical abuse and against others for financial abuse.
