Broker’s Compensation

Compensation of a real estate agent is strictly a matter of negotiation between broker and principal; the parties are free to agree to any amount or manner of compensation and may condition the broker's entitlement to compensation on any lawful basis.

Three general conditions must be satisfied before real estate brokers are entitled to compensation from their principals:

  • The broker must have a valid real estate license
  • There must be a written agreement between broker and principal sufficient to satisfy the statute of frauds; and
  • The specific conditions of the broker's contract with the principal must have been satisfied
