Land development in California is generally subject to three types of regulatory controls:
- Planning and zoning regulation, through which general development policies are determined;
- Environmental regulation, which is designed to control development in light of environmental considerations; and
- Permitting regulation, through which individual development projects are approved or disapproved in accordance with planning and environmental criteria.
These types of controls, which are imposed on real estate development by statute or ordinance, must be distinguished from construction and use restrictions imposed in deeds or leases of real property or in contracts relating to realty.
