Product Labeling

Consumer packages and their labels should allow individuals to access accurate information as to the quantity and quality of the contents. The general purpose is to facilitate informed purchasing and value comparisons. To this end, The Fair Packaging and Labeling Act, as well as other legislation, was enacted to protect purchasers of any covered commodity against deception or misrepresentation.

Misbranding or Improper Product Labeling can take many forms including:

  • The label itself is false or misleading.
  • The label does not meet federal nutrition or health requirements
  • The packaging does not identify the name and place of business of the manufacturer, packer or distributor.
  • The item is offered as an imitation but the label does not have the word imitation immediately following the item imitated.
  • The label does not indicate that the product as artificial flavoring, coloring or other preservative.
  • The container itself is misleading.
  • The label does not warn that the contents are perishable.
